Case No. NSCI201200385 was a civil legal action as plaintiff filed June 12th 2012 by Reina Nido Berrios claiming division and distribution of her participation in Rafael Francisco Nido Goenaga et.al 38 Luquillo Beach Blvd. Luquillo Puerto Rico property.  In the complaint claimed to be true, proven and confirmed that Jorge Rafael Nido Colom using exclusively 38 Luquillo Beach Blvd., Luquillo, Puerto Rico and had "deprived her of the rightful possession and enjoyment of said property".

On DECEMBER 12th, 2006, Rafael Mariano Nido signed 'INSTANCIA' afidavit number #2517 before attorney/notary Nestor Machado Cortez, declaring in writing SUCCESSION RAFAEL FRANCISCO NIDO GOENAGA AND PARTIAL PARTITION AND ADJUDICATION OF HEREDITARY PROPERTY ‘Escritura no 630/2006, recorded with the Fajardo Registrors office records for Luquillos’ municipality, Page (Folio) 142, Book (Tomo) 280 as fifth (5th ) and sixth (6) inscription for Estate (Finca) number one thousand seven hundred and sixty seven (1,767).

On DECEMBER 12th, 2006 Rafael Francisco Nido Goenaga et.al per affidavit #4825 signed before Attorney/Notary Rolando Silva agreed to not occupy 38 Luquillo Beach Blvd., Luquillo, Puerto Rico and put it immediately for sale. Milagros Nido Figueroa and Reina Nido Berrios at the signing of  PARTIAL PARTITION AND ADJUDICATION OF HEREDITARY PROPERTY DEED (Escritura) no 630/2006, threatened they would not sign the "Warranty Deed" unless all parts of Rafael Francisco Nido Goenaga et.al signed affidavit #4825 (not occupy 38 Luquillo Beach Blvd., Luquillo, Puerto Rico and put it immediately for sale). Rafael Mariano Nido Figueroa was the only one out of Rafael Francisco Nido Goenaga et.al who stood to lose from the intent to do harm if affidavit #4825 not signed. 
 
 
Signing meant: 
-Immediate danger of not having a place to stay temporarily.
-Losing a place to temporarily keep in storage personal belongings and,
-Lose a place to temporarily keep in storage Inherited property. 
 
Keeping sight of all the work it had taken to solve in an equitable manner Case No. KAC961488 and clearly defining to all parts the immediate danger of not having a place to stay temporarily and temporarily keep in storage Inherited property. Rafael Mariano Nido Figueroa succumbed and signed affidavit #4825 under coercion.

On January 9th, 2007, Milagros Nido Figueroa passed away. 
 
Between April thru June of 2007, Rafael Mariano Nido Figueroa tried to list Property for sale. Reina Nido Berrios would not sign listing agreement without Milagros Nido Figueroa resolution of heirs

Between December 12th, 2006 and the summer of 2009 38 Luquillo Beach Blvd. Luquillo Puerto Rico had been vandalized (some windows stolen), driveway gates missing and the yard was overwhelmed by overgrown tall grass and weeds. The real estate taxes were in arrears’ and Reina Nido Berrios still unwilling to sign listing agreement placing 38 Luquillo Beach Blvd. Luquillo, Puerto Rico for sale. 
 


Saturday, June 27th, 2009, Jorge Rafael Nido Colom volunteered to improve 38 Luquillo Beach Blvd., Luquillo, Puerto Rico for the benefit of all. Rafael Mariano Nido Figueroa clearly in writing empathizing 'improving the property as you propose--each participant may use the common things, provided that they dispose of them according to their purpose and in a way that does not harm the interest of the community, nor prevent the co-participants from using them according to their right.'
 
Both Rafael Mariano Nido Figueroa and Mariolga Nido Colom agreed to let Jorge Rafael Nido Colom to move into 38 Luquillo Beach Blvd. Luquillo Puerto Rico property to improve for the benefit of all. To activate electricity (electricity account AEE #034-0294383-002-4) and water (water account AAA #113943700030). Mariolga Nido Colom provided Jorge Rafael Nido Colom $1,500 to pay AEE (The Puerto Rico Electric Power Authority Co.) to start electric service back at 38 Luquillo Beach Blvd. Property.  
 
NOTE: Rafael Mariano Nido Figueroa asked Jorge Rafael Nido Colom to send him pictures of the house after improvements and keys to the new front door locks and padlocks. Jorge Rafael Nido Colom said he would. As of this writing (April 27th 2026) Jorge Rafael Nido Colom has neither sent pictures of the house after improvements and keys to the new front door locks and padlocks to Rafael Mariano Nido Figueroa. 



SUMMARY OF EVENTS 
Case No. NSCI201200385 

June 12th 2012 Reina Nido Berrios filed civil legal action as plaintiffs in Fajardo Puerto Rico against Rafael Mariano Nido Figueroa et.al. Reina Nido Berrios claimed division and distribution of her participation of 38 Luquillo Beach Blvd., Luquillo, Puerto Rico. In the complaint claimed to be true, proven and confirmed that Jorge Rafael Nido Colom using exclusively 38 Luquillo Beach Blvd., Luquillo, Puerto Rico and had "deprived her of the rightful possession and enjoyment of said property". A lawsuit involving trespass and nuisance.

Rafael Mariano Nido Figueroa co-defendant counter claimed as plaintiff.. In the counter claim complaint wrongful acts of appellees have not only deprived him of the rightful possession and enjoyment of said property; but doing so, caused him damages in the sums alleged in the counter claimed.

March 31st 2014 Reina Nido Berrios passed away. 

On April 15th 2015 Ruben Enrique Guzman Reyes Attorney at Law for Jorge Rafael Nido Colom motion the court that Jorge Rafael Nido Colom had found a buyer for 38 Luquillo Beach Blvd., Luquillo, Puerto Rico for $220,000.00. Ruben Enrique Guzman Reyes Attorney at Law for Jorge Rafael Nido Colom asked and argued contracting a Realtor unnecessary and requested Jorge Rafael Nido Colom be able to sell the property for $220,000.00.
 
On September 16th, 2015 Luis Otero-Garabis attorney for Rafael Mariano Nido Figueroa motioned for Final Sentence. All parts in agreement with the sale of the property; inclusive mentioned Reina Nido Berrios and Alexis Danielle Russo (Milagros Nido Figueroa Resolution of Heirs’ case EJV2008-0222) had no objections and, that all that was needed it's the court's approval of the sale.Failing to mention, among other things, that Reina Nido Berrios had passed away on March 31st, 2014 "Intestate" with no "Resolution of Heirs’ to date.
 
September 29th, 2015 Honorable Ignacio E. Morales Gómez grants its approval and issues a ruling in accordance with the terms and conditions expressed September 16th, 2015
  
NOTE: Between March 31st 2014 thru April 20h 2016 the court was not made aware of the fact that Reina Nido Berrios had passed away and the need for Reina Nido Berrios Resolution of Heirs’ 
 
On February 25, 2016 Rafael Mariano Nido Figueroa wrote Honorable Ignacio E. Morales Gómez and explained the case no. NSCI2012-00385 is not resolved. That he had been led into error. “There is no transaction, no stipulations, and no agreements. And the need for Reina Nido Berrios Resolution of Heirs’
 
On April 20th 2016, filed April 26th 2016, Luis Otero-Garabis attorney for Rafael Mariano Nido Figueroa lets the court know there is no buyer and that he resigns’ from representing Rafael Mariano Nido Figueroa.

On July 12, 2016, the aforementioned Judgment (September 29th, 2015) was declared null and void due to a lack of essential parts.
 
On February 2, 2017, the Court ordered the co-defendant-counter claimant and plaintiff  to amend his allegations, under penalty of dismissal of the Counterclaim and the Claim against Co-party for lack of indispensable parties.
 
May 3rd 2017, Resolution of heirs Reina Nido Berrios established. Rafael Mariano Nido Figueroa financed Reina Nido Berrios 'Resolution of heirs' promising Reina Nido Berrios et.al. dismissal of the Counterclaim and the Claim against Co-party.

On May 7th 2019 Honorable Thainie Reyes Ramirez decreed that in the absence of indispensable parties (Resolution of heirs' case: EJV2017-0211) the court, seeing that a final, effective, and equitable resolution was impossible without these parties, ordered the case dismissed, closed, and archived rendered all subsequent actions of the court null and void.
